With reference to your letter of the 26th January (63748/ 1917) transmitting a copy of a despatch from the Governor of Hong kong relative to the trade marke of Messrs. Arnhold
harberg and Company, I am directed by the Board of Trade to
state that they concur in Mr. Secretary Long's proposal to inform Kesers. Arnhold that the assignment of the marks to
them can be made only if their rights are placed by the Court beyond dispute.
As regards the question of consideration raised by the
Governor, the Board agree that it would be difficult to ask
Messrs. Arnhold for any specific payment in respect of the Trade Marks if they prove that they are in fact entitled to the
goodwill of the business without any other liability than the
of, the
payment firm's debts. Mr. Long way however think it well in
any arrangement that may be made to exact an undertaking that
the liabilities of the old firm will be paid by Messrs. Ambold.
